Terms and conditions of Sale USA
Giuseppe Zanotti s.p.a., a company registered in Italy (corporate register number 02067600409), with registered office at Via dell’ Artigianato 28, 47030 San Mauro Pascoli (FC), Italy (“Giuseppe Zanotti”), sells products from the collections identified by the Giuseppe Zanotti trademark and the Giuseppe Junior trademark (the “Products”) directly to its customers on this site www.giuseppezanotti.com (the “Site”). The sale of the Products on the Site is subject to the following terms and conditions of sale (the “Conditions of Sale”).
2.1.The Products present on the Site are offered for sale only to consumers (“Customer(s)” or “You”), the term "Customer" means any natural person making purchases for purposes which are outside his trade business, craft of profession. Products on the Site may be purchased only by persons aged 18 years and over having reached age of majority. The Products sold on the Site may be purchased and shipped only to the United Kingdom, European Union and to non-member states of the European Union listed on the Site (excluding United States, China and Hong Kong).
2.2. Before confirming and submitting a purchase order, the Customer shall read carefully and accept these Conditions of Sale. These Conditions of Sale govern together with the Privacy Policy the contract between the Customer and Giuseppe Zanotti for the sale of Products on the Site.
2.3. In submitting a purchase order, the Customer accepts and undertakes to observe these Conditions of Sale. Should the Customer not accept any of the conditions indicated in these Conditions of Sale, he/she shall not submit a purchase order for Products on the Site.
3.1. To purchase one or more Products, the Customer must select the Products, their size and colour. The Products selected for purchase will be added to the Shopping Bag. To be able to save articles in the Shopping Bag to continue shopping at a later time, the Customer must first create an online account and log in to this account at the time of purchase. Purchases can be made without an online account/registration, but any items in the Shopping Bag will be deleted if the purchase is not completed, and the Customer will be required to make selections for purchase again the next time he/she visits the Site.
3.2. The Customer may modify any information he/she enters during the purchase procedure at any time until the order is confirmed. The Customer will no longer be able to change or cancel the order once it has been sent.
3.3. The sale procedure will be considered complete only when the Customer sends the purchase order to Giuseppe Zanotti by clicking on the “Buy Now” button at the bottom of the purchase confirmation page. To send the order, the Customer must provide personal data, including his/her name, address, e-mail address and payment information. He/she will also be required to check a box stating that he/she accepts these Conditions of Sale. Before sending the order, we recommend the Customer carefully review the order, including Product information, shipping costs, the conditions for contract withdrawal (the “Information on the right of withdrawal”, see point 7 below), legal warranty information and the Privacy Policy.
3.4. Once the order has been sent, Giuseppe Zanotti will send the Customer an e-mail confirming receipt of the order by Giuseppe Zanotti and its processing (“Order Confirmation”). The Customers may access the order at any time in the “My account” section on the Site, if he/she has registered, or by contacting our Customer Service department at customercareen@giuseppezanotti.com.
Please note that Order Confirmation does not constitute acceptance of the Customer's order by Giuseppe Zanotti. Giuseppe Zanotti will accept the order and debit the amounts due to the Customer's payment card only once the Products have been shipped. At that time, Giuseppe Zanotti will send the Customer another confirmation e-mail indicating that the order has been accepted and that the Products have been sent (“Shipping Confirmation”). The order invoice will be attached to the Shipping Confirmation e-mail.
3.5. Giuseppe Zanotti reserves the right to refuse to accept orders placed by the Customer should it consider they fail to meet the requirements for sending a purchase order or to accept orders placed by persons with whom a legal dispute is underway regarding a previous order or for any other legitimate reason, without being required to provide any reason. Giuseppe Zanotti reserves the right to refuse to accept and to refuse to fill orders that appear to have been placed by merchants and/or distributors.
3.6. Every Product offered for sale on the Site will include an image of the Product, its unit price, and available colours and sizes. Product images are provided for information purposes only. Images and colours of the Products for sale on the Site do not necessarily match the actual colours due to the browser and/or monitor used or for other technical reasons. Giuseppe Zanotti cannot be held liable for any inexact graphic representations of the Products shown on its Site for the aforementioned technical reasons.
4.1. Giuseppe Zanotti undertakes to guarantee the availability of all Products offered on its Site. However, under exceptional circumstances, the Products sold by Giuseppe Zanotti on the Site may not be available. Giuseppe Zanotti invites the Customer to check availability of the Products sold on the Site at the time of purchase, by contacting the Customer Service Department at customercareen@giuseppezanotti.com.
4.2. Should the Products ordered by the Customer be temporarily unavailable (except for pre-orders and orders for Products with limited availability whose availability date is clearly indicated), Giuseppe Zanotti will inform the Customer via e-mail by the business day following the order date. The Customer's credit card will not be debited if the Products are unavailable. If the amount of the purchase has already been debited, a refund will be credited to the credit card used to place the order within 14 (fourteen) days. It may be necessary to attend specific bank timing before having visibility of such credit depending on each bank conditions. Giuseppe Zanotti cannot influence bank credit times which are the discretion of each individual financial institution.
4.3. Customers will be notified when orders are sent for pre-orders, orders for Products with reduced availability or orders for articles not available at the time of order, but for which the availability date is clearly stated on the Site. If, under exceptional circumstances, availability times are extended, the Customer will be informed when the Product is available two weeks after the date indicated at the time of order.
5.1. The Prices of the Products available for sale on the Site are expressed in EUR (€) for sales in the European Union and non-member states of the European Union listed on the Site (excluding United States, China, Hong Kong) in pounds sterling (£) for sales to the United Kingdom and in CAD for sales to Canada.
5.2. All Product Prices include VAT (if delivered to the European Union) or other taxes or duties (if delivered outside the EU in the rest of the world).
5.3. Giuseppe Zanotti accepts payment by MasterCard, Visa, American Express and PayPal.
5.4. For Payment by MasterCard, Visa, American Express and PayPal purchased products will be sent to the Customer following verification of the Customer's payment card data and after receipt of debit authorisation from the Customer's bank. Verification of payment card data may be delayed, but will be done as quickly as possible, and generally takes no more than 24 hours. However, longer times may sometimes be required.
5.5. All Products are provided with an identification card and identification number that are an integral part of the Product. The Customer must not remove the identification card with the identification number until he/she has verified that the Product matches the order or until he/she has decided not to exercise his/her order withdrawal right as per point 7 below.
6.1. The Products will be sent to the address provided during the purchase process. For security reasons, Giuseppe Zanotti will not send orders to post office boxes nor will it accept orders in cases where the order recipient's identity or the physical person's address cannot be verified.
6.2. After sending Shipping Confirmation to the Customer, all purchases will be delivered from Monday to Friday, excluding local or national public holidays, by the courier service chosen by Giuseppe Zanotti, based on availability, unless otherwise stated for specific countries. Saturday deliveries may be available if offered by the Courier.
6.3. Products are delivered within 1-2 working days from Shipping Confirmation, depending on the shipping address and the country in which the Customer resides. Giuseppe Zanotti cannot be held liable for unforeseen delays and/or delays attributable exclusively to the Courier. Before sending purchases to the Customer, Giuseppe Zanotti may be required to confirm the Customer's details with the card issuer for the payment via credit card. Giuseppe Zanotti undertakes to do its utmost to reduce delays as much as possible considering that these transactions generally require no more than 24 hours.
6.4. Should the Customer not receive the Products within 7-10 (seven to ten) business days of receipt of the Shipping Confirmation, he/she should contact Giuseppe Zanotti on the number 08000859129. Customers can also contact us by e-mail at customercareen@giuseppezanotti.com.
6.5. Pre-ordered articles will be shipped as soon as they become available, as indicated on the Site at order placement. The Customer will receive a Shipping Confirmation e-mail as soon as the order has been shipped and delivery will be made within the same amount of time as other orders, depending on the chosen type of delivery.
7.1 Giuseppe Zanotti reserves the right to modify or correct these Conditions of Sale, its Privacy Policy, Information on the Right of Withdrawal, the Products offered for sale on the Site and the prices of these Products at any time and without notice. Giuseppe Zanotti invites the Customer to carefully read the Conditions of Sale and the Privacy Policy whenever using the Site to make a purchase.
7.2. Giuseppe Zanotti will do its utmost to ensure the Product prices and information on the Site are accurate and up to date. However, there may occasionally be printing errors, incorrect statements or omissions ("Errors") regarding the description, price, promotions, sales and Product availability. Giuseppe Zanotti reserves the right, at any time and without notice, to correct the Errors, modify or update information, delete sales containing said Errors and cancel any order at any time prior to shipping.
7.3. The Customer will be informed immediately via e-mail by Giuseppe Zanotti (in any case, no more than 24 hours of order cancellation) should the Customer's payment card be debited for a cancelled order as per point 8.2, and a refund will be made to the Customer's payment card within 14 (fourteen) days of order cancellation.
7.4. Any modifications and/or corrections indicated above apply exclusively to purchase orders sent after the date on which the modification or correction was made by Giuseppe Zanotti.
8.1. The Customer must check the Products at the time of delivery to ensure they match the order.
8.2. Any anomalies discovered at the time of delivery, such as damage or tampering with packaging, damage to Products, missing articles, non-compliant Products, defective Products, etc. (“Defects”), may be indicated by the Customer directly to the Courier with a written and signed comment on the delivery notice provided by the Courier. In this case, the Customer will not be required to accept the Products and may return them directly to the Courier.
8.3. If Defects are discovered after delivery, the Customer may return the Products to Giuseppe Zanotti using the procedure described in point 10 below.
9.1. Consumers are entitled to return a product through the Site for a refund without any reasons, within 15 days from the date of receipt of the Products purchased on the Site, but solely as permitted in this Section. When exercising the right of withdrawal Consumers are not allowed to change the purchased Product with another Product.
9.2. In order to return any purchased Product, Consumers are required to return the merchandise in its original ‘as new’ condition to the GZ USA Returns Center.
Products purchased online cannot be returned for a refund to GZ USA stores.
9.3. A refund will be issued to the purchaser of the Product, provided that Products are returned unused, unwashed and in the same condition in which they were delivered, with all original labels attached and complete with all parts and accessories using their original packaging. In case the right of return is exercised for all the Products included in the same purchase order, all Products must be returned to us contemporaneously with the same shipment.
9.4 GZ USA reserves the right to inspect the Products returned and to refuse the return of those Products which do not comply with the requirements specified under 9.3 above.
9.5. A full refund, excluding the original shipping costs, will be issued to the same means of payment used for the purchase as soon as possible and in any case within 14 (fourteen) days from the date on which GZ USA has first acknowledged the receipt of the returned merchandise sent by the Consumer, and provided that the conditions described under section 9.3 above have been met.
In case of return of Products purchased as a gift (i.e. Products shipped to a recipient different from the person who made the payment), the refund will be issued to the person who made the payment. The clearance date of the repayment will be the same as the initial payment to GZ USA. As a consequence, the party who made the payment will not suffer any loss in terms of bank interest.
Check the presence of the label and commercial documents accompanying the Products within the package;
Request from the Courier a copy of the receipt for the collection of the Product, duly signed by the Courier, and keep it as evidence of the collection. In this case all the shipping costs, including the costs for returning the Products to GZ USA will be borne by GZ USA.
If the consumer elects not to use the Courier used by GZ USA, GZ USA recommends that Consumers insure the whole value of the Product being returned, obtain and carefully preserve the shipping receipt and number. In this case shipping costs for returning the Products shall be borne by the Consumer and GZ USA will not be liable for refunding the price of Products sent by the Consumer which have not been received by GZ USA as a consequence of loss, theft or damage not attributable to GZ USA.

10.1. The Products sold on the Site are sold "based on availability". Notwithstanding the legal warranty referred to in point 10.1 above, Giuseppe Zanotti issues no warranty, condition, commitment or term, whether express or implicit, by contract or any other means, regarding the condition, service, satisfactory quality or fitness for a specific purpose of the Products other than the Product description included in the purchase order, and all of the aforementioned warranties, conditions, commitments and terms of any kind are excluded to the fullest extent permitted by law.
10.2. Under no circumstances may Giuseppe Zanotti be held liable for damages of any kind such as direct, indirect, incidental or consequential damages caused to the Customer deriving directly or indirectly from:
- the Customer's use or inability to use the Site
- the Customer's trust in the information provided on the Site
- errors, service interruptions, cancellations, file and e-mail damage or corruption, viruses or defects, delays in operation or transmission, communication failures, theft, destruction or unauthorised access to Giuseppe Zanotti data, programs or services
10.3. Notwithstanding points 12.1 and 12.2, nothing in these Conditions of Sale shall exclude or limit the liability of Giuseppe Zanotti to the Customer for cases of fraud, death or personal injury caused by negligence, breach of the terms pursuant to the applicable norms in relation to consumer protection or any other responsibility that cannot be excluded or limited according to applicable law.
11.1. The laws of the State of New York (without giving effect to its conflicts of law principles) govern all matters arising out of or relating to these Terms of Sale, including, without limitation, their validity, interpretation, construction, performance, and enforcement. All legal proceedings arising out of or in connection with these Terms and Sale shall be brought solely in the City of New York, State of New York.
11.2. Our failure to exercise or enforce any right or provision of these Terms of Sale will not operate as a waiver of such right or provision. The section titles in these Terms of Sale are for convenience only and have no legal or contractual effect. The word including means “including without limitation”. If any provision of these Terms of Sale is, for any reason, held to be invalid or unenforceable, the other provisions in these terms will be unimpaired and the invalid or unenforceable provision will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law. Your relationship to GZ USA is that of an independent contractor, and neither party is an agent or partner of the other. These Terms of Sale, and your rights and obligations herein, may not be assigned, subcontracted, delegated, or otherwise transferred by you without our prior written consent, and any attempted assignment, subcontract, delegation, or transfer in violation of the foregoing will be null and void. The terms of these Terms of Sale will be binding upon assignees. We shall not be liable for any delay or failure in performance caused by circumstances beyond our reasonable control.

Pursuant to Article 14 of European Regulation 524/2013, Giuseppe Zanotti informs the Customer that in the event of a dispute, the Customer may lodge a complaint via the ODR (Online Dispute Resolution) platform provided by the European Commission via the following link http://ec.europa.eu/consumers/odr/. However Giuseppe Zanotti invites the Customer to contact our customer service department directly at ccustomercareen@giuseppezanotti.com to resolve any problem directly.
Any requests for repairs can be sent via portal linked in the footer. Remember to always specify the date and place of purchase. For purchases made on our site, also specify the order number. Always attach detailed photos of the problem requiring assistance, of the soles and the entire shoe, so that our experts can see them and offer their opinion. Giuseppe Zanotti products have a legal warranty of 24 months. If the defect is attributable to quality, the item must be returned to the company for repair, exchange or refund. In the case of use-related issues, where possible our experts will propose repairs made for a fee.
14.1. Customers have the right to withdraw from their purchase contract with Giuseppe Zanotti, without penalty and for any reason, within 15 days of receipt of the Products purchased on the Site. Exercise of the right of withdrawal does not grant the Customer the right to exchange purchased Products with other Products. The right of withdrawal does not apply to orders for customised products such as, by way of example but not limited to, products with a customer's initials etched onto them and bespoke products made according to specific instructions provided by the customer, including those customised after being purchased.
14.2. To exercise their right of withdrawal, Customers must inform Giuseppe Zanotti of their intention to withdraw from the contract at customercareusa@giuseppezanotti.comm. Customers may also use the form available here. In this case, the Customer must return the Products in their original "like new" condition to the Returns Centre of Giuseppe Zanotti (indicated in point 7.8 below). All Products purchased online must be returned to the Giuseppe Zanotti Returns Centre. Returns sent to our sales points will not be accepted.
14.3. Customers will be granted refunds provided the Products have not been used or washed, and are in the same condition in which they were delivered, with original tags attached, with all parts and accessories and in original packaging. Should the Customer exercise his/her right of withdrawal for all Products of a single purchase order, all of the Products must be returned in the same shipment at the same time.
14.4. Giuseppe Zanotti reserves the right to check the returned Products and to send back to the Customer any Products it considers fail to meet the requirements indicated in point 7.3 above.
14.5. A full refund (except for deductions of applicable custom duties, as explained at point 7.9. of Terms & Conditions of Sale) will be made to the payment card or to the bank account used for the purchase as soon as possible, and in any case, within 14 (fourteen) days of the date on which Giuseppe Zanotti initially confirmed receipt of the returned Products sent by the Customer, provided the conditions listed in point 7.3 above are met. In any case, Giuseppe Zanotti will make the refund as soon as the Customer proves the Product has been returned. Should the Customer expressly request a more costly delivery method different from the less costly method generally proposed by Giuseppe Zanotti, Giuseppe Zanotti will be obliged to refund delivery costs only up to the amount the Customer would have paid had he/she accepted the proposed less costly delivery method generally accepted by Giuseppe Zanotti.
14.6. If the returned Products were purchased as a gift, the refund will be made to the person having made payment. The payment date of the refund will be the same as that of the initial payment to Giuseppe Zanotti. Therefore, the party making payment will not be subject to any bank interest charges.
14.7. To return Products to Giuseppe Zanotti, the Customer must contact the Courier to pick up the Products he/she intends to return by Courier from the residence or domicile where the Products are located. The return shipping label provided with the delivered package must be affixed to the outside of the package. The Customer must also ensure that the commercial label and documents for the Products are included in the package and make a copy of the receipt for the return of the Products duly signed by the Courier, keeping it as proof of return. Should the Courier be used to return Products, all shipping costs, including the costs of returning Products to Giuseppe Zanotti, will be borne by Giuseppe Zanotti.
14.8. Should the Customer choose not to use the Courier, Giuseppe Zanotti recommends the Customer insure the entire value of the returned Product and obtain and retain the shipping receipt and number. In this case, any costs for returning the Products will be borne by the Customer, and Giuseppe Zanotti cannot be held liable for reimbursing the price of the Products sent by the Customer if they are not received by Giuseppe Zanotti due to loss, theft or damage not attributable to Giuseppe Zanotti.
14.9. If the items returned cannot be accepted due to non-compliance, the customer will be informed via email within a reasonable period of time. In this case, the customer will be able to have the items redelivered at their own expense. If the customer refuses to do so, Giuseppe Zanotti reserves the right to withhold the items and the amount paid for the purchase.

14.10 Giuseppe Zanotti applies a transparent tax policy, showing tax-excluded prices, and applying any taxes and duties at checkout. Therefore you do not need to pay anything else to the courier or to customs authorities upon delivery. If you decide to return an item, Giuseppe Zanotti will take care of the taxes and duties that apply to your return. We will refund you the purchase price only (excluding any taxes and duties that applied at the time of purchase). This does not limit any rights and remedies you may have under applicable laws, including the consumer guarantees.
