Términos y condiciones de venta

Giuseppe Zanotti s.p.a. empresa inscrita en Italia (inscrita en el Registro de Empresas con el número 02067600409), con domicilio social en Via dell'Artigianato 28, 47030 San Mauro Pascoli (FC), Italia ("Giuseppe Zanotti"), vende productos de las colecciones identificadas por la marca Giuseppe Zanotti y la marca Giuseppe Junior (los "Productos") directamente a sus clientes en este sitio www.giuseppezanotti.com (el "Sitio"). La venta de los Productos en el Sitio estará sujeta a los siguientes términos y condiciones de venta (las "Condiciones de Venta"). 

2.1. Los Productos presentes en el Sitio se ofrecen a la venta únicamente a los consumidores ("Cliente(s)" o "Usted"), el término "Cliente" se refiere a cualquier persona física que realice compras con fines distintos de los comerciales, artesanales o profesionales.  Los Productos en el Sitio pueden ser comprados sólo por personas mayores, de 18 años o que han alcanzado la mayoría de edad. Los Productos vendidos en el Sitio pueden ser comprados y enviados únicamente al Reino Unido, la Unión Europea y a estados no miembros de la Unión Europea enumerados en el Sitio (excepto Estados Unidos, China y Hong Kong).

2.2. Antes de confirmar y enviar un pedido de compra, el Cliente deberá leer atentamente y aceptar estas Condiciones de Venta. Las presentes Condiciones de Venta regulan, junto con la Política de Privacidad, el contrato entre el Cliente y Giuseppe Zanotti para la venta de Productos en el Sitio.

2.3. Al enviar un pedido de compra, el Cliente acepta y se compromete a observar estas Condiciones de Venta. En caso de que el Cliente no acepte alguna de las condiciones indicadas en estas Condiciones de Venta, no deberá enviar una orden de compra de Productos en el Sitio.

3.1. To purchase one or more Products, the Customer must select the Products, their size and colour. The Products selected for purchase will be added to the Shopping Bag. To be able to save articles in the Shopping Bag to continue shopping at a later time, the Customer must first create an online account and log in to this account at the time of purchase. Purchases can be made without an online account/registration, but any items in the Shopping Bag will be deleted if the purchase is not completed, and the Customer will be required to make selections for purchase again the next time he/she visits the Site.  

3.2. The Customer may modify any information he/she enters during the purchase procedure at any time until the order is confirmed. The Customer will no longer be able to change or cancel the order once it has been sent.

3.3. The sale procedure will be considered complete only when the Customer sends the purchase order to Giuseppe Zanotti by clicking on the “Buy Now” button at the bottom of the purchase confirmation page. To send the order, the Customer must provide personal data, including his/her name, address, e-mail address and payment information. He/she will also be required to check a box stating that he/she accepts these Conditions of Sale. Before sending the order, we recommend the Customer carefully review the order, including Product information, shipping costs, the conditions for contract withdrawal (the “Information on the right of withdrawal”, see point 7 below), legal warranty information and the Privacy Policy.

3.4. Once the order has been sent, Giuseppe Zanotti will send the Customer an e-mail confirming receipt of the order by Giuseppe Zanotti and its processing (“Order Confirmation”). The Customers may access the order at any time in the “My account” section on the Site, if he/she has registered, or by contacting our Customer Service department at customercareen@giuseppezanotti.com.

Please note that Order Confirmation does not constitute acceptance of the Customer's order by Giuseppe Zanotti. Giuseppe Zanotti will accept the order and debit the amounts due to the Customer's payment card only once the Products have been shipped. At that time, Giuseppe Zanotti will send the Customer another confirmation e-mail indicating that the order has been accepted and that the Products have been sent (“Shipping Confirmation”). The order invoice will be attached to the Shipping Confirmation e-mail.

3.5. Giuseppe Zanotti reserves the right to refuse to accept orders placed by the Customer should it consider they fail to meet the requirements for sending a purchase order or to accept orders placed by persons with whom a legal dispute is underway regarding a previous order or for any other legitimate reason, without being required to provide any reason. Giuseppe Zanotti reserves the right to refuse to accept and to refuse to fill orders that appear to have been placed by merchants and/or distributors. 

3.6. Every Product offered for sale on the Site will include an image of the Product, its unit price, and available colours and sizes. Product images are provided for information purposes only. Images and colours of the Products for sale on the Site do not necessarily match the actual colours due to the browser and/or monitor used or for other technical reasons. Giuseppe Zanotti cannot be held liable for any inexact graphic representations of the Products shown on its Site for the aforementioned technical reasons. 

4.1. Giuseppe Zanotti se compromete a garantizar la disponibilidad de todos los Productos ofrecidos en su Sitio. Sin embargo, bajo circunstancias excepcionales, los Productos vendidos por Giuseppe Zanotti en el Sitio pueden no estar disponibles. Giuseppe Zanotti invita el Cliente a verificar la disponibilidad de los Productos vendidos en el Sitio en el momento de la compra, contactando con el Servicio de Atención al Cliente en customercarees@giuseppezanotti.com. 

4.2. En caso de que los Productos solicitados por el Cliente no estén disponibles temporalmente (excepto para pedidos anticipados y pedidos de Productos con disponibilidad limitada cuya fecha de disponibilidad está claramente indicada), Giuseppe Zanotti informará al Cliente por correo electrónico dentro del día laborable siguiente a la fecha del pedido. Si los productos no están disponibles, ningún cargo se realizará en la tarjeta de crédito del Cliente. Si el importe de la compra ya ha sido cobrado, se acreditará un reembolso a la tarjeta de crédito utilizada para realizar el pedido dentro de 14 (catorce) días. Podría ser necesario esperar más tiempo antes de poder visualizar el reembolso en la cuenta de la tarjeta de crédito, dependiendo de las condiciones especificas de la institución financiera del Cliente. Giuseppe Zanotti no puede influir en los plazos de procesamiento de reembolsos que están a discreción de cada institución financiera correspondiente. 

4.3. Los Clientes serán notificados cuando se envíen pedidos para pedidos anticipados, pedidos de Productos con disponibilidad limitada o pedidos de artículos no disponibles en el momento del pedido, pero cuya fecha de disponibilidad se indica claramente en el Sitio. Si en circunstancias excepcionales se producen demoras de disponibilidad de dos semanas a partir de la fecha indicada en el momento del pedido, contactaremos con el Cliente para informarle sobre la disponibilidad del Producto. 

5.1. Los Precios de los Productos disponibles para la venta en el Sitio se expresan en EUR (€) para las ventas en la Unión Europea y en los estados que no pertenecen a la Unión Europea enumerados en el Sitio (excepto Estados Unidos, China, Hong Kong),  en GBP (£) para las ventas en el Reino Unido y en CAD para las ventas en Canadá.

5.2. Todos los precios de los productos incluyen el IVA (si se entregan en el Reino Unido o en la Unión Europea) u otros impuestos o aranceles (si se entregan en el resto del mundo fuera de la UE) salvo que se indique lo contrario durante el proceso de compra. Los precios no incluyen los gastos de envío que figurarán por separado. Los gastos de envío dependen del destino y del método de envío seleccionado en el momento de la compra. Los gastos de envío y cualquier otro impuesto aplicable aparecerán en la página del pago de la Confirmación del Pedido.

5.3.Giuseppe Zanotti acepta el pago con MasterCard, Visa, American Express y PayPal.

5.4. Para el pago con MasterCard, Visa, American Express y PayPal los productos adquiridos se enviarán al Cliente tras la verificación de los datos de la tarjeta de pago del cliente y tras la recepción de la autorización de adeudo del banco del Cliente. La verificación de los datos de la tarjeta de pago puede demorarse, pero se realizará lo más rápido posible y, por lo general, no demorará más de 24 horas. Sin embargo, a veces pueden ser necesarios tiempos más largos.

5.5. Todos los Productos se proporcionan con una tarjeta de identificación y un número de identificación que forman parte integrante del Producto. El Cliente no debe retirar la tarjeta de identificación con el número de identificación hasta que haya verificado que el Producto coincide con el pedido o hasta que haya decidido no ejercer su derecho de desistimiento según el punto 7 a continuación.

6.1. Los Productos se enviarán a la dirección proporcionada durante el proceso de compra. Por razones de seguridad, Giuseppe Zanotti no enviará pedidos a apartados de correos ni aceptará pedidos en los casos en que la identidad del destinatario del pedido o la dirección de la persona física no puedan ser verificadas.

6.2. Todas las compras serán entregadas por la empresa de transporte elegida por Giuseppe Zanotti, a menos que se indique lo contrario para países específicos y de lunes a viernes, excluyendo los días festivos locales o nacionales, una vez enviada la Confirmación de Envío al Cliente, en función de la disponibilidad indicada. Las entregas en sábado pueden estar disponibles si las ofrece el Mensajero.

6.3. Los productos se entregarán en 1-2 días hábiles a partir de la confirmación de envío, según la dirección de envío y el país de entrega del cliente. Giuseppe Zanotti no se hace responsable de demoras imprevistas y/o imputables exclusivamente al Mensajero. Antes de enviar las compras al Cliente, Giuseppe Zanotti podría precisar la confirmación de los detalles del Cliente con el emisor de la tarjeta. Giuseppe Zanotti se compromete a realizar su mayor esfuerzo para reducir las demoras lo más posible, considerando que estas transacciones generalmente no tardan más de 24 horas. 

6.4. Si el Cliente no recibe los Productos dentro de los 7-10 (siete-diez) días hábiles después de la recepción de la Confirmación de Envío, tendrá que contactar con Giuseppe Zanotti en el número 900 822 714. Los Clientes también pueden contactar con nosotros por correo electrónico en customercarees@giuseppezanotti.com.

6.5. Los pedidos anticipados serán enviados tan pronto como sean disponibles, como indicado en el Sitio en el momento de la realización del pedido. El Cliente recibirá un correo electrónico de Confirmación de Envío tan pronto como el pedido sea enviado y la entrega se realizará en los mismos plazos previstos para otros pedidos, según la tipología de entrega seleccionada.

7.1. Giuseppe Zanotti se reserva el derecho de modificar o corregir estas Condiciones de Venta, su Política de Privacidad, la Información sobre el Derecho de Desistimiento, los Productos ofrecidos a la venta en el Sitio y los precios de estos Productos en cualquier momento y sin previo aviso. Giuseppe Zanotti invita al Cliente a leer atentamente las Condiciones de Venta y la Política de Privacidad cada vez que utilice el Sitio para realizar una compra.

7.2. Giuseppe Zanotti hará todo lo posible para garantizar que los precios de los Productos y la información en el Sitio sean exactos y estén actualizados. Sin embargo, ocasionalmente puede haber erratas, declaraciones incorrectas u omisiones ("Errores") con respecto a la descripción, precio, promociones, ventas y disponibilidad del Producto. Giuseppe Zanotti se reserva el derecho, en cualquier momento y sin previo aviso, de corregir los Errores, modificar o actualizar la información, eliminar las ventas que contengan dichos Errores y cancelar cualquier pedido en cualquier momento antes del envío.

7.3. El Cliente será informado inmediatamente por correo electrónico por Giuseppe Zanotti (en cualquier caso, no más de 24 horas de la cancelación del pedido) si en su la tarjeta de pago ha sido realizado un cargo por un pedido cancelado según el punto 8.2, y se realizará un reembolso a la tarjeta de pago del Cliente dentro de los 14 (catorce) días de la cancelación del pedido.

7.4. Cualquier modificación y/o corrección mencionada anteriormente se aplicará exclusivamente a los pedidos de compra confirmados después de la fecha en la que Giuseppe Zanotti realizó la modificación o corrección.

8.1. El Cliente debe comprobar los Productos en el momento de la entrega para asegurarse de que se corresponden con el pedido.

8.2. Cualquier anomalía detectada en el momento de la entrega, como daños o manipulación del embalaje, daños en los Productos, artículos faltantes, Productos no conformes, Productos defectuosos, etc. («Defectos»), podrá ser indicada por el Cliente directamente al Transportista mediante un comentario escrito y firmado en el albarán de entrega facilitado por el Transportista. En este caso, el Cliente no estará obligado a aceptar los Productos y podrá devolverlos directamente al Transportista.

8.3. Si los Defectos se detectan después de la entrega, el Cliente podrá devolver los Productos a Giuseppe Zanotti siguiendo el procedimiento descrito en el punto 10 más abajo.

10.1.Los Productos vendidos en el Sitio se venden "según disponibilidad". No obstante la garantía legal mencionada en el punto 10.1 anterior, Giuseppe Zanotti no emite garantía, condición, compromiso o términos, ya sea expreso o implícito, por contrato o cualquier otro medio, con respecto a la condición, servicio, calidad satisfactoria o idoneidad para una utilización de los Productos que no sea prevista por la descripción del Producto incluida en el pedido compra, y todas dichas garantías, condiciones, compromisos y términos de cualquier tipo antes mencionados están excluidos en la máxima medida permitida por la ley.

10.2. Giuseppe Zanotti no será responsable bajo ninguna circunstancia por daños de cualquier tipo, como daños directos, indirectos, incidentales o consecuentes causados al Cliente, derivados directa o indirectamente de:

1. el uso o la incapacidad del Cliente de utilizar el Sitio
2. la confianza del Cliente en la información proporcionada en el Sitio
3. errores, interrupciones del servicio, cancelaciones, daños o corrupción de archivos y correos electrónicos, errores de software, virus o defectos, demoras en la operación o transmisión, fallas de comunicación, robo, destrucción o acceso no autorizado a los datos, programas o servicios de Giuseppe Zanotti

10.3. No obstante lo dispuesto en los puntos 12.1 y 12.2, nada en estas Condiciones de Venta excluirá o limitará la responsabilidad de Giuseppe Zanotti ante el Cliente por casos de fraude, muerte o lesiones personales causadas por negligencia, violación de los términos de conformidad con las normas aplicables en relación con la protección del consumidor o cualquier otra responsabilidad que no pueda ser excluida o limitada de acuerdo con la ley aplicable.

Pursuant to Article 14 of European Regulation 524/2013, Giuseppe  Zanotti informs the Customer that in the event of a dispute, the Customer may lodge a complaint via the ODR (Online Dispute Resolution) platform provided by the European Commission via the following link http://ec.europa.eu/consumers/odr/. However Giuseppe Zanotti invites the Customer to contact our customer service department directly at ccustomercareen@giuseppezanotti.com to resolve any problem directly.

Any requests for repairs can be sent via email to: customercareusa@giuseppezanotti.com or via chat. Remember to always specify the date and place of purchase. For purchases made on our site, also specify the order number. Always attach detailed photos of the problem requiring assistance, of the soles and the entire shoe, so that our experts can see them and offer their opinion. Giuseppe Zanotti products have a legal warranty of 24 months. If the defect is attributable to quality, the item must be returned to the company for repair, exchange or refund. In the case of use-related issues, where possible our experts will propose repairs made for a fee.

16.1. Customers have the right to withdraw from their purchase contract with Giuseppe Zanotti, without penalty and for any reason, within 15 days of receipt of the Products purchased on the Site. Exercise of the right of withdrawal does not grant the Customer the right to exchange purchased Products with other Products. The right of withdrawal does not apply to orders for customised products such as, by way of example but not limited to, products with a customer's initials etched onto them and bespoke products made according to specific instructions provided by the customer, including those customised after being purchased.

16.2. To exercise their right of withdrawal, Customers must inform Giuseppe Zanotti of their intention to withdraw from the contract at customercareusa@giuseppezanotti.comm. Customers may also use the form available here. In this case, the Customer must return the Products in their original "like new" condition to the Returns Centre of Giuseppe Zanotti (indicated in point 7.8 below). All Products purchased online must be returned to the Giuseppe Zanotti Returns Centre. Returns sent to our sales points will not be accepted.

16.3. Customers will be granted refunds provided the Products have not been used or washed, and are in the same condition in which they were delivered, with original tags attached, with all parts and accessories and in original packaging. Should the Customer exercise his/her right of withdrawal for all Products of a single purchase order, all of the Products must be returned in the same shipment at the same time.

16.4. Giuseppe Zanotti reserves the right to check the returned Products and to send back to the Customer any Products it considers fail to meet the requirements indicated in point 7.3 above.

16.5. A full refund (except for deductions of applicable custom duties, as explained at point 7.9. of Terms & Conditions of Sale) will be made to the payment card or to the bank account used for the purchase as soon as possible, and in any case, within 14 (fourteen) days of the date on which Giuseppe Zanotti initially confirmed receipt of the returned Products sent by the Customer, provided the conditions listed in point 7.3 above are met. In any case, Giuseppe Zanotti will make the refund as soon as the Customer proves the Product has been returned. Should the Customer expressly request a more costly delivery method different from the less costly method generally proposed by Giuseppe Zanotti, Giuseppe Zanotti will be obliged to refund delivery costs only up to the amount the Customer would have paid had he/she accepted the proposed less costly delivery method generally accepted by Giuseppe Zanotti.

16.6. If the returned Products were purchased as a gift, the refund will be made to the person having made payment. The payment date of the refund will be the same as that of the initial payment to Giuseppe Zanotti. Therefore, the party making payment will not be subject to any bank interest charges.

16.7. To return Products to Giuseppe Zanotti, the Customer must contact the Courier to pick up the Products he/she intends to return by Courier from the residence or domicile where the Products are located. The return shipping label provided with the delivered package must be affixed to the outside of the package. The Customer must also ensure that the commercial label and documents for the Products are included in the package and make a copy of the receipt for the return of the Products duly signed by the Courier, keeping it as proof of return. Should the Courier be used to return Products, all shipping costs, including the costs of returning Products to Giuseppe Zanotti, will be borne by Giuseppe Zanotti.

16.8. Should the Customer choose not to use the Courier, Giuseppe Zanotti recommends the Customer insure the entire value of the returned Product and obtain and retain the shipping receipt and number. In this case, any costs for returning the Products will be borne by the Customer, and Giuseppe Zanotti cannot be held liable for reimbursing the price of the Products sent by the Customer if they are not received by Giuseppe Zanotti due to loss, theft or damage not attributable to Giuseppe Zanotti.

16.9. If the items returned cannot be accepted due to non-compliance, the customer will be informed via email within a reasonable period of time. In this case, the customer will be able to have the items redelivered at their own expense. If the customer refuses to do so, Giuseppe Zanotti reserves the right to withhold the items and the amount paid for the purchase.

16.10 Giuseppe Zanotti applies a transparent tax policy, showing tax-excluded prices, and applying any taxes and duties at checkout. Therefore you do not need to pay anything else to the courier or to customs authorities upon delivery. If you decide to return an item, Giuseppe Zanotti will take care of the taxes and duties that apply to your return. We will refund you the purchase price only (excluding any taxes and duties that applied at the time of purchase). This does not limit any rights and remedies you may have under applicable laws, including the consumer guarantees. Should you need further information, we invite you to contact your local customs office directly.
